The three-year clock

April 1, year three. Foreclosed. Title goes to the county. The house is no longer yours.

The word that confuses everybody

“Forfeited” does not mean you lost the house.

On March 1 of year two, your property is forfeited — but you still own it and you can still pay to get it back. People read that letter, assume it is over, and stop trying.

The date you actually lose ownership is March 31 into April 1 of year three. That date does not move, does not get extended, and does not care about your circumstances.

The deadline that is actually live right now

March 31, 2027 is the current deadline, covering 2024 and prior taxes.

Be careful what you read on this. The March 31, 2026 deadline has already passed, and some county pages and a lot of competitor websites still display it as though it were current. If a page is quoting you a 2026 date, it is out of date.

What help still exists

Macomb runs one program rather than a menu: a Hardship Extension, with three tiers. You apply through the Treasurer’s office with proof of income, two years of tax returns, ID or proof of occupancy, and a statement of what you own and owe.

One thing to know going in: the county does not publish fixed terms. There is no advertised interest rate or payment length. You propose terms as part of the application. That means it is worth calling and asking rather than assuming you would not qualify.

Rental properties may not be eligible — the county’s older guidance says hardship extensions are for owner-occupied homes and businesses. Confirm by phone, because that guidance sits on a page that has not been updated in some time.

Two programs are gone, and you will still see both advertised.

The state’s foreclosure-avoidance agreements under MCL 211.78q(5) — the ones that reduced your interest rate — sunset on June 30, 2026 when the authorizing law expired. Replacement legislation has been introduced but not passed.

And MIHAF, the Michigan Homeowner Assistance Fund, stopped taking applications on December 8, 2023. The state’s own landing page still reads as if it were open. It is not.

What happens at auction

Macomb runs its tax foreclosure auctions online at zeusauction.com. In 2026 they were held September 9 and October 14. Registration is a two-step process and closes at 4:00 PM the day before the sale.

Foreclosed properties get offered first to the State, then to your city or township, then to the county. Whatever is left goes to public auction.

There is one thing people try that does not work: you cannot buy your own foreclosed house back at auction for less than what you owed. State law does not allow it. Waiting for the auction to pick your house up cheap is not a plan.

In 2020 the Michigan Supreme Court decided a case called Rafaeli. The ruling was straightforward: if the county sells your house for more than you owed in taxes, keeping the difference is unconstitutional. That money belongs to you.

The deadlines are strict and there are three of them:

By July 1 right after the foreclosure — file Form 5743 with the Treasurer. It has to be notarized, and delivered either in person or by certified mail with return receipt.

By January 31 — the Treasurer sends you Form 5744 with the sale figures.

Between February 1 and May 15 — you file a motion in Macomb County’s 16th Circuit Court. The law says it cannot be filed after May 15. Not “should not.” Cannot.
